These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client") and AfterHours Septic LLC ("AfterHours Septic," "we," "us," or "our") governing your access to and use of The Siren System platform and all related services. By signing a service proposal, submitting payment, or using our services, you agree to these Terms.
AfterHours Septic provides The Siren System, a done-for-you automated after-hours communication platform for septic service professionals. Services include configuration of automated SMS workflows, AI voice receptionist setup (VAPI), emergency alert system (Pushover/Siren), GoHighLevel CRM setup, onboarding automation, review request automation, e-signature proposal delivery (Docuseal), and related services as described in your service proposal.
Specific services, features, and deliverables are determined by the tier selected (Starter, Pro, or Elite) as outlined in your signed proposal.
Services are provided on a subscription basis at the following rates:
Starter: $350 one-time setup fee + $297/month. Includes core missed call response, AI lead qualification, automated follow-up, and review request automation. VAPI AI Voice Receptionist available as add-on at $97/month.
Pro: $500 one-time setup fee + $497/month. Includes all Starter features plus Siren emergency alert system, priority notification routing, and client-branded one-page website template. VAPI AI Voice Receptionist available as add-on at $97/month.
Elite: $997 one-time setup fee + $697/month. Includes all Pro features plus VAPI AI Voice Receptionist, Three-Layer Emergency Response Net, and advanced workflow customization.
Setup fees are due at signing and cover the cost of building and configuring your system. Monthly subscription billing begins at go-live, after your system is fully configured and your toll-free number is verified. All pricing is in USD.
Payments are processed through Stripe. By providing payment information, you authorize AfterHours Septic to charge the applicable setup fee at signing and recurring monthly subscription fees beginning at go-live.
Monthly subscriptions are billed in advance on a recurring basis. Failed payments may result in service suspension. You are responsible for keeping payment information current.
Setup fees are non-refundable once system configuration has begun, as they represent the cost of labor to build your system.
As a client of AfterHours Septic, you agree to: provide accurate business information during onboarding, complete the onboarding survey in a timely manner to facilitate go-live, maintain a valid payment method on file, comply with all applicable laws in your jurisdiction regarding SMS communications with your customers, and obtain any required consents from your customers (homeowners) before initiating communications through the platform.
You are solely responsible for the content of communications sent to your customers through the platform and for compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any other applicable regulations.
AfterHours Septic will obtain and verify a dedicated toll-free number for your account as part of the setup process. Toll-free verification may take up to 10 business days. Monthly billing begins after verification is complete and your system is live.
SMS communications through the platform must comply with carrier requirements including proper opt-in consent, STOP/HELP keyword support, and message content guidelines. AfterHours Septic is not liable for message delivery failures caused by carrier filtering, recipient opt-outs, or client-provided content that violates carrier policies.
The Siren System, including all automation workflows, templates, and system configurations developed by AfterHours Septic, remains the intellectual property of AfterHours Septic LLC. You are granted a limited, non-exclusive license to use the system during your active subscription.
Client-provided content (business name, logo, custom messaging) remains your property. You grant AfterHours Septic a license to use your content solely for the purpose of configuring and operating your system.
Both parties agree to keep confidential any proprietary information, business processes, or trade secrets disclosed during the course of the service relationship. This obligation survives termination of the service agreement.
AfterHours Septic provides services through third-party platforms including GoHighLevel, Make.com, VAPI, Pushover, Stripe, and Docuseal. We are not liable for service interruptions, outages, or failures caused by these third-party providers. We will make reasonable efforts to restore service in the event of disruptions.
AfterHours Septic's liability to you for any claims arising from these Terms or the use of our services is limited to the total amount paid by you in the three (3) months preceding the claim. AfterHours Septic is not liable for lost profits, missed business opportunities, or indirect, incidental, or consequential damages.
You agree to indemnify and hold AfterHours Septic LLC, its owners, employees, and agents harmless from any claims, damages, or expenses (including legal fees) arising from your use of the platform, your communications with your customers, your violation of these Terms, or your violation of any applicable law or regulation.
Either party may terminate the service agreement with 30 days written notice. You may cancel by emailing [email protected]. Upon termination, your system access will be deactivated at the end of the current billing period. Setup fees are non-refundable. Unused subscription days are non-refundable.
AfterHours Septic reserves the right to terminate service immediately for non-payment, violation of these Terms, or use of the platform for unlawful purposes.
AfterHours Septic reserves the right to modify these Terms at any time. Changes will be posted to afterhoursseptic.com with an updated effective date. Continued use of services after changes constitutes acceptance of the updated Terms. Material changes will be communicated via email with at least 14 days notice.
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes shall be resolved in the courts of DeWitt County, Illinois.
These Terms, together with your signed service proposal, constitute the entire agreement between you and AfterHours Septic regarding the services described herein and supersede all prior agreements or understandings.
